Welcome to Rise Trivia (the "Platform", "we", "us", or "our"). By accessing our website, registering an account via Google Sign-In, or participating in any live quiz events (each, an "Event"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. The Platform and all associated Events are strictly restricted to users who are at least eighteen (18) years old, legal residents of the United States, and physically located within the United States at the time of participation. If you do not agree to these Terms, if you are under eighteen (18) years old, if you are not a legal U.S. resident, or if you are located outside the United States at the time of participation, you may not access or participate in our Events. Events are void where prohibited by law.

1. Eligibility & Account Registration

• Age Restriction: You must be at least eighteen (18) years old to access the Platform, register an account, participate in an Event, or claim any prize. By accessing the Platform or participating in an Event, you represent that you are at least eighteen (18) years old.
• Geographic Restriction: You must be a legal resident of the United States and physically located within the United States at the time of participation to register an account, play in an Event, or claim any prizes. Accessing the Platform via a Virtual Private Network (VPN), proxy, or other routing software to mask a non-U.S. location is an explicit violation of these Terms. We may use account information, technical information, IP address or geolocation signals, payout-provider verification, and manual review to evaluate eligibility and suspected violations.
• Single Account Requirement: To participate in an Event, users must register and authenticate exclusively through a valid, individual Google Account. Each physical person is permitted to register and play using only one (1) unique account.
• Multiple Accounts and Account Manipulation: Creating, using, controlling, or attempting to benefit from multiple accounts is strictly prohibited. This includes using alternate Google accounts, account-sharing arrangements, email alias tricks, placeholder accounts, or any other method intended to give one person more than one entry or more than one chance to win. Any participant found to be using multiple accounts may be disqualified and will forfeit any prize won.
• Accurate Information: You agree to maintain accurate account details. We reserve the right to request identity, eligibility, and payout verification before awarding any prize.
• Eligibility Certification: By participating in an Event, you certify that you are at least eighteen (18) years old, are a legal resident of the United States, are physically located within the United States while participating, are using only one account, and agree to these Terms, the Privacy Policy, and any applicable Event-specific official rules.

2. Game Integrity, Fair Play, and Anti-Cheating Policy

To maintain a fair competitive environment for all participants and our sponsors, we enforce anti-cheating protocols.

• Individual Play Only: Each participant must play for themselves using their own account. Participants may not submit answers for another person, allow another person to play on their behalf, or coordinate account use in a way that gives any participant an unfair advantage.
• Automated Scripts & Bots: The use of automated scripts, browser extensions, macros, bots, or any third-party software designed to monitor network traffic, including WebSocket communication, automate answer selections, or manipulate response times is strictly prohibited.
• Scoring Logic: Scores are automatically calculated by our server based on accuracy, response timing, and any applicable Event-specific rules. Leaderboard placement may be determined by score, answer accuracy, network-received response times, and tie-breaker rules announced for the Event. Bypassing the frontend user interface to submit answers directly to our backend endpoints constitutes an immediate breach of these Terms and may result in disqualification or a permanent ban.
• Event-Specific Official Rules: Each Event may be subject to additional official rules, prize descriptions, eligibility requirements, deadlines, sponsor terms, scoring details, or tie-breaker rules posted before or during that Event. Those Event-specific official rules are part of these Terms for that Event. If Event-specific rules conflict with these Terms, the Event-specific rules will control for that Event.
• Disqualification: We reserve the right to disqualify any participant, remove leaderboard entries, withhold or revoke prize eligibility, or ban accounts if we determine that the participant violated these Terms, manipulated the game, used multiple accounts, provided false information, or attempted to gain an unfair advantage.

3. Prizes, Awards, and Winner Verification

• United States Residency and Location Requirement: Prize eligibility is restricted to individuals who are at least eighteen (18) years old, legal residents of the United States, and physically located within the United States at the time they participate in an Event. We reserve the right to require verification of age, residency, identity, location eligibility, and payout eligibility before awarding any prize.
• Apparent Winners: Any leaderboard result, score result, or winner announcement is provisional until the winner's eligibility has been verified. A participant may be identified as an apparent winner before a prize is officially awarded.
• Payout Verification: To receive a cash prize, an apparent winner may be required to complete identity, address, tax, bank account, and payout eligibility verification through Stripe or another approved payout provider. This may include providing information or documents required by the payout provider. We may rely on the payout provider's verification status, along with our own records and review, to determine whether a prize may be paid.
• Failure to Complete Verification: If an apparent winner does not complete the required verification process within fourteen (14) days of the Event's conclusion, cannot be verified as eligible, is under eighteen (18) years old, provides inaccurate information, or is otherwise determined to be ineligible, the apparent winner may be disqualified and may forfeit the prize.
• Multiple Accounts: Each individual person may participate using only one account. Creating, using, controlling, or attempting to benefit from multiple accounts in the same Event is prohibited. If we determine that an individual used multiple accounts, attempted to use multiple accounts, or caused another account to be used on their behalf, that individual may be disqualified and will forfeit any prize won.
• Technical Disclaimers: The Platform relies on real-time internet connectivity. We are not responsible for lost scores, missed questions, connection drops, network latency, device issues, browser issues, or local hardware/software problems experienced by a participant. No compensation, prize substitution, or score adjustment will be issued due to technical issues outside of our direct control.
• No Purchase Necessary: Entry to all competitive Events is free. A purchase, payment, donation, or transaction will not increase a participant's chances of winning. Events are void where prohibited by law. Prize winners are solely responsible for any applicable local, state, or federal taxes associated with accepting a prize.

4. Sponsor Engagement & Marketing Communications

• Sponsor Communications: Participation in prize-supported Events is free. By participating in an Event, you agree that Rise Trivia may send limited sponsor-related communications connected to that Event.
• Post-Event Email: By participating, you consent to receive up to one (1) post-quiz promotional email sent by Rise Trivia on behalf of the sponsor associated with that specific Event. Your email address will not be sold, rented, leased, or provided to the sponsor for the sponsor's independent marketing use unless you separately choose to provide your information directly to that sponsor. Promotional emails will include legally required sender information and opt-out or unsubscribe information where required by applicable law.
• Limitation of Sponsor Liability: While Rise Trivia hosts the Event, specific prize funding, external coupons, or promotional products may be the responsibility of an Event sponsor. Rise Trivia is not responsible for sponsor-manufactured goods or services, except as required by applicable law or a written agreement.

5. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE PLATFORM DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL OPERATE ERROR-FREE, UNINTERRUPTED, OR FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS.

6. Limitation of Liability & Indemnification

• Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RISE TRIVIA, ITS CREATORS, OWNERS, OPERATORS, AFFILIATES, SPONSORS, OR AGENTS BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST PRIZE OPPORTUNITIES, OR DAMAGES RESULTING FROM LOST DATA, CONNECTION ISSUES, TECHNICAL ERRORS, OR BUSINESS INTERRUPTION, RESULTING FROM THE USE OR INABILITY TO USE THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
• Liability Cap: To the maximum extent permitted by law, Rise Trivia's total liability for any claim arising out of or relating to an Event, prize, account, or use of the Platform will not exceed the prize amount at issue for the relevant Event or one hundred dollars ($100), whichever is greater. This limitation does not apply where prohibited by applicable law.
• Indemnity: You agree to defend, indemnify, and hold harmless Rise Trivia, its founders, operators, affiliates, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your breach of these Terms, your violation of any law, or your misconduct during an Event.

7. Governing Law and Jurisdiction

These Terms, your access to the Platform, and all disputes arising out of or relating to our live quiz Events shall be governed by, and construed in accordance with, the laws of the State of Ohio, without regard to its conflict of law principles. You explicitly agree that any legal action, suit, or proceeding arising under or in connection with these Terms shall be brought exclusively in the state or federal courts located in the State of Ohio.

8. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable by any court having competent jurisdiction, the invalidity or unenforceability of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. These Terms constitute the entire agreement between you and Rise Trivia regarding your use of the website and participation in Events.

9. Modifications to the Agreement

We reserve the right to update or modify these Terms at any time to reflect updates to our game logic, security infrastructure, business practices, or legal requirements. Continued participation in our live quizzes following changes constitutes acceptance of the revised Terms.
